    Understanding California's Electronic Visit Verification

    The Department of Health Care Services (DHCS) in California has mandated that all Medi-Cal-funded home care agencies implement Electronic Visit Verification (EVV) in two phases.

    CALIFORNIA EVV PHASE I:

    For Phase I of the California Medicaid program (known as Medi-Cal), all provider agencies were required to use the state EVV system of their chosen vendor. Phase I was implemented on January 01, 2021.

    CALIFORNIA EVV PHASE II:

    Sandata was selected as the state aggregator for Phase II. Home Health Care and Personal Care agencies in California were allowed to use either the CalEVV system or their preferred vendor as long as that provider could successfully aggregate with Sandata. Phase II implementation date was January 01, 2022.

    It is not just strict EVV Standards that California follows, the state also has stringent Federal Home Care Regulations that must be followed. A few of these regulations are as follows:

    • California High Court has ruled that home care workers are entitled to compensation for live-ins including sleep breaks.
    • Home care workers who earn the minimum wage per hour are entitled to additional pay known as a “split shift premium” when their schedule includes a split shift.
    • Home caregivers in California are generally entitled to unpaid breaks throughout their shift. In a facility, the caregiver is required to take an unpaid break every four hours.
    • Home care employees who have a change in worksite location must be compensated for any travel time over the time normally required to report to their regular work site.
    • Home care agencies with five or more employees must provide up to 12 weeks of leave in a 12-month period to employees who have worked for at least a year under the CFRA.
    • Beyond the minimum wage, overtime pay is due for domestic caregivers who work longer hours.

    The Home Care Services Bureau (HCSB) is responsible for licensing Home Care Organizations, including responding to complaints, processing applications, and conducting unannounced visits to ensure compliance.

    HCSB also assists in the Home Care Aide application process and maintenance of the Home Care Aide Registry.

    A split shift is a work schedule that divides an employee's workday into two or more parts. The shifts are usually two or more hours apart. A standard one-hour lunch break associated with a 9-to-5 schedule does not qualify for a split shift. It is always your employer’s legal responsibility to keep accurate time records of hours worked as well as payroll records.

    Live-Ins are 24-hour shifts where a caregiver stays in the client’s home and sleeps there as well. California High Court has ruled that workers are entitled to compensation for all on-call time, including sleep time.

    Beyond minimum wage, overtime pay is due for domestic caregivers who work longer hours:

    • 40+ regular hours a workweek: a caregiver is entitled to overtime for the 41st hour and beyond, paid at “time and a half.”
    • 9+ regular hours in a workday in a private home: a caregiver is also entitled to overtime, for the 10th hour and beyond, paid at “time and a half.”
    • 8+ regular hours in a workday in a facility: a caregiver is also entitled to overtime, for the 9th hour and beyond, paid at “time and a half.”
    • For seven full days of straight work within a workweek, caregivers are entitled to “double-time.” Hours beyond 12 in a workday are also paid as “double-time.”

    California has strict rules and regulations to ensure patient safety and security. The state has made EVV mandatory and imposed safety checks and training to reduce the chances of fraud and elderly abuse.
